Employee messengers

Messenger services have become a business necessity.  However, if they don’t operate lawfully, and you are not careful, they can bring you trouble in the form of a lawsuit.

Messenger service companies, while requiring a license, are relatively easy to establish. Because it is possible that the messenger company may not have the proper insurance, it is essential that you request and obtain a certificate of insurance, The certificate of insurance should include workers compensation for the messengers/couriers as well as the office staff, and should include vehicle liability for the messengers. This certificate should show evidence of acceptable limits, and include a statement that all messengers/couriers (employees or independent contractors) are covered. Most people assume that all messenger services are bonded. This is a falsehood. To be bonded you must have employees, for it is called an employee dishonesty bond. Hence, having employees is the only way to ensure that you will not be exposed to any uninsured claims.
